Kano High Court Warns Police Officer Of Imprisonment Over Contempt

    By Abdullahi Yusuf

The Kano State High Court presided over by Justice Aisha Mahmoud, has issued a stern warning to Assistant Commissioner of Police (ACP) Babagana Bukar of Zone 1 Police Headquarters, BUK Road, Kano, over his failure to comply with a subsisting court order earlier issued by Justice Yusuf Ubale

The judge cautioned that continued disobedience may amount to contempt of court, a serious offense that could result in imprisonment.

    Background of the Case

The matter stems from a dispute over House No. QA-270, located at Panisau in Ungogo Local Government Area of Kano State.

The applicant, Abba Shittu Sharubutu, filed an ex parte motion in April 2026 against several respondents, including: Isiyaku Auwalu (popularly known as Dan Kwangila), The Nigerian Police Force, AIG Zone 1 Kano State, ACP Babagana Bukar and Inspector Dauda Usman (IPO).

It was gathered that after hearing the applicant’s counsel, Barrister Muhammad Kelechi Nwabueze, Justice Ubale granted an interim injunction ordering all parties to maintain the status quo regarding the property until the motion on notice is determined.

The court also directed that service of processes be effected through the appropriate police authority before the next adjourned date.

The presiding judge Justice Mahmoud expressed grave concern that ACP Bukar had not complied with the order.

Despite the subsisting court order directing all parties to maintain the status quo, ACP Bukar allegedly compelled the occupants of the property to vacate.

She stressed that failure to obey judicial directives undermines the authority of the court and warned that such defiance could lead to contempt proceedings.

“Disobedience of this court’s order will not be tolerated. ACP Babagana Bukar risks being committed to prison for contempt if he continues to disregard the directive,” the judge declared.

The case has been adjourned to 13th July 2026 before Justice Aisha Mahmoud for hearing of the motion on notice.

Meanwhile, the court has made it clear that any further disregard of its orders will attract severe consequences, including imprisonment of the contemnor.
